✅ What actually passed (per the adopted minutes): The city’s draft minutes of the September 16 meetings — placed on the October 7 agenda for approval and since signed — record all five members present at all three sessions (Mayor Duncan, Mayor Pro Tem Munzing and Councilmembers Ackley, Dwyer and Zandbergen). Closed session: the City Attorney “stated no reportable action was taken.” Consent items 4.1 through 4.7 were approved 5–0 on a motion by Munzing, seconded by Dwyer — including the $601,567.85 in accounts payable, Resolution No. 2026-24 reappropriating FY 2025-26 fund balances and amending the FY 2026-27 budget, the receive-and-file of the applicant’s withdrawal of the medical office application at 27412 Aliso Creek Road, and adoption of the 2025-2026 CAPER. Councilmember Ackley pulled item 4.8, the lease renewal with Family Assistance Ministries at Playa Circle, and “directed staff to omit addresses associated with proposed lease renewals with Family Assistance Ministries from public meeting materials, to the extent permitted by law”; the renewal was then approved 5–0 on her motion, seconded by Munzing. Study session: the year-end report was received and filed 5–0; per the minutes, the Director of Financial Services reported “a General Fund surplus of $5.1 million,” with revenues of $32.9 million and expenditures of $27.8 million, approximately $1.3 million under budget. There were no public hearings or discussion items. Updated October 9, 2026: the signed minutes, approved by Mayor Duncan and the City Clerk and now posted on the city’s portal, match the draft on every vote and figure reported here.
The headline: behind closed doors the city is negotiating price and terms for public facilities at four separate properties with four homebuilders — Shea Homes, Meritage Homes, Brandywine Homes and Lennar. In open session, a proposed large outpatient medical office at 27412 Aliso Creek Road that sought a parking reduction is off the table: the applicant has withdrawn, and the council is only asked to receive and file the withdrawal letter.
🏗 Closed session: four builders, four properties
- Conference with real property negotiators under Government Code Section 54956.8, with City Manager Brett Channing as agency negotiator in each. Under negotiation in all four: “price and terms of payment for public facilities.” Closed Session 2
- 27081 Aliso Creek Road — negotiating with Emilie Simard, Shea Homes. Closed Session 2
- 400-700 Freedom Lane — negotiating with Vanessa Scheidel, Meritage Homes. Closed Session 2
- 15 Argonaut — negotiating with Emanuel Robinson of Brandywine Homes. Closed Session 2
- 26800-26970 Aliso Viejo Parkway — negotiating with JR Jones, Lennar. Closed Session 2

🏥 A medical office application is withdrawn
- The conditional use permit and exception permit to establish a large outpatient medical office with a reduced number of required parking spaces at 27412 Aliso Creek Road (USE-2026-01005 and EXP-2026-01001) is on consent with one recommended action: “Receive and file the Applicant’s request to withdraw the application.” The applicant’s withdrawal letter is an attachment. - Study session: the year-end picture. The council will receive and file a presentation on Fiscal Year 2025-26 year-end results and a five-year financial forecast. No action beyond receive-and-file is listed. Study Session

The agenda states no rent or term. Item 4.8
- CDBG year-end report. The council would find the 2025-2026 Consolidated Annual Performance and Evaluation Report is not a project under CEQA Guidelines Section 15378(b)(5), adopt the CAPER, and authorize the City Manager to submit it to the U.S. Department of Housing and Urban Development.
