What Brea is about to decide

Brea’s council meets as a special meeting, general session at 6:30 p.m., in the Council Chambers, 1 Civic Center Circle, sitting also as the Successor Agency to the Brea Redevelopment Agency. The agenda is short — a consent calendar and then the 2026 State of the City address at 7:00 p.m. There is no closed session and no public hearing. These are pending decisions from the posted agenda — not outcomes. Every item links to the official record.

✅ What actually passed (per the adopted minutes record): The city’s minutes record on AgendaLink — now marked as adopted minutes — shows the general session running from 6:32 p.m. to 7:13 p.m. with all five members present. The consent calendar passed 5-0 in one motion by Stewart, seconded by Simonoff, at 7:12 p.m.: Hupp, Marick, Simonoff, Stewart and Vargas all voting yes. The adopted record words the motion as one “to approve Consent Calendar items 2A - 2G, excluding item 2D.” Ordinance No. 1277 (higher e-bike fines) was not adopted that night: the draft minutes of this meeting, attached to the council’s October 6 agenda packet, record the motion as approving consent items 2A–2G “excluding item 2D” and state that Item 2.D, the second reading of Ordinance No. 1277, “was removed from the Consent Calendar and will return at a later date.” The second reading is on the October 6 agenda as Item 3.C. The 5-0 consent vote approved the Tracks at Brea Trail easement with Oltmans Investment Company, LLC at 3200 Nasa Street, adopted Resolution No. 2026-64 (Conflict of Interest Code) and Resolution No. 2026-65 setting the October 20, 2026 public hearing on the Waste Water Disposal Company pipeline franchise, and received the disbursement registers, the August 31 investment report and the August 18 minutes. The two Successor Agency items passed 5-0 on a separate motion by Stewart, seconded by Simonoff. The record lists the State of the City presentation by Mayor Cecilia Hupp with no action, and shows public comment running from 6:46 to 7:11 p.m. Updated October 8, 2026: the record is now marked as adopted minutes; its text matches the draft, including Item 2.D being “removed from the Consent Calendar.” Updated October 9, 2026: the draft minutes record of the October 6 meeting states that the council “waived full reading and adopted Ordinance No. 1277” on a 5-0 consent vote that night; see the October 6 brief.
Correction (October 2, 2026): an earlier version of this section said the 5-0 consent vote adopted Ordinance No. 1277 and that the higher e-bike fines “are now law.” That was wrong. The AgendaLink record we relied on showed a single consent motion without the exclusion; the city’s draft minutes, published in the October 6 agenda packet, show the item was pulled before the vote. The ordinance has not been adopted. We regret the error.
The headline: the council is set to adopt Ordinance No. 1277 on second reading, revising Brea’s electric mobility device regulations and increasing e-bike fine amounts — the step that makes the higher fines law. On consent it would also grant an easement at 3200 Nasa Street for the Tracks at Brea Trail extension, and set an October 20 public hearing on a wastewater pipeline franchise.
