What Dana Point is about to decide

Dana Point’s council meets with closed session at 5:00 p.m. and regular business at 6:00 p.m. in the City Council Chamber, 33282 Golden Lantern, Suite 210. No public hearings are scheduled — the agenda lists that section as “None.” These are pending decisions from the posted agenda — not outcomes. Every item links to the official record.

✅ What actually passed (per the draft minutes): The city’s draft minutes of the September 15 meeting — on the October 6 agenda for approval, not yet adopted — record three of five members present (Mayor Gabbard, Mayor Pro Tem Frost and Council Member Federico), with Council Members Pagano and Villar absent; every vote was 3–0 (Ayes: Federico, Frost, Gabbard). The local emergency resolution was adopted: Resolution 26-09-15-04, “proclaiming existence of a local emergency on September 9, 2026,” on a motion by Federico, seconded by Frost. The minutes still do not describe the emergency in the resolution text, but they record three speakers addressing the council “regarding the local emergency on Beach Road” and the City Manager thanking staff and council “for their efforts in responding to the local emergency on Beach Road.” Both ADU ordinances were adopted on second reading as part of the consent calendar — Ordinance 26-07 (ZTA26-0002) and Ordinance 26-08 (ZTA26-0003) — along with Resolutions 26-09-15-01, -02 and -03 on salary ranges, 2027 health benefit allowances and the Conflict of Interest Code. Short-term rentals: on a motion by Gabbard, seconded by Frost, the council directed “that the city staff return with further data prior to issuing additional short-term rental permits and consult with the California Coastal Commission regarding temporary short-term rental permits for the 2028 Olympics.” The Tourism Business Improvement District annual report was received and filed, and the council received the proposed appeal-procedure code changes without a vote. The Assistant City Attorney reported nothing out of closed session. We will update this page if the council amends the minutes before approving them.
The headline: the council will consider a resolution proclaiming the existence of a local emergency on September 9, 2026. The agenda gives the resolution title only — it does not say what the emergency is, what it would authorize, or how long it would last. Separately, two accessory dwelling unit ordinances get their second reading, which is the step that makes them law, and the council takes up the short-term rental program and is asked to give staff direction on future policy.
